Between, on or about, April 2021 and May 2021, while practicing as a registered social worker, Mr Capper conducted himself in an inappropriate and/or unprofessional manner by failing to maintain professional boundaries and/or entered into an inappropriate relationship with [Miss A] (then aged 13 years) and with the family [Miss A], who was then a prior client of Mr Capper
Result/Orders/Penalties
a. Mr Capper is censured.
b. The following conditions are to be placed on Mr Capper’s practising certificate when issued: that Mr Capper receives supervision from an external supervisor, being a senior registered social worker, on a monthly basis for a minimum of 6 months with a focus on the Code of Conduct and professional boundaries. Mr Capper’s supervisor is to report to the Board at 6 months and on completion of supervision (if ongoing after 6 months). Mr Capper to disclose the Tribunal’s decision to his supervisor, current employer and any prospective employer for a period of two years. Mr Capper does not engage in social work with tamariki/rangatahi until satisfactory report from his external supervisor to the Board.27
c. Mr Capper is to pay costs to the PCC in the sum of $7804.35.
d. Mr Capper is to pay costs to the Tribunal in the sum of $4263.68.
